You agree to comply with and be bound by the following Terms and Conditions of Service (“Terms”) by using Positive Mind Care’s services. If you do not agree to these terms, please do not use our services or Website.

These Terms and the Privacy Policy constitute a legal agreement (“Agreement”) between you and Positive Mind Care in connection with your website visit and use of the Services.

This Agreement applies to those services made available by Positive Mind Care on the Website, which are offered to the Users, The Services may change from time to time, at the sole discretion of Positive Mind Care, and the Agreement will apply to your visit to and your use of the Website to avail the Service.

Your access to the use of the Website and the Services will be solely at the discretion of Positive Mind Care.

The Agreement is published in compliance with and is governed by the provisions of Indian law, including but not limited to:

• the Indian Contract Act 1872,
• the (Indian) Information Technology Act, 2000, and

• the rules, regulations, guidelines, and clarifications framed there under, including the (Indian) Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011 (the “SPI Rules”), and the (Indian) Information Technology (Intermediaries Guidelines) Rules, 2011 (the “IG Rules”).

Services

• Positive Mind Care provides individuals and groups with healthcare services, including Psychiatric Consultation, Psychodiagnostics Evaluation, Online & Offline Psychological Counseling, Online Yoga & Meditation, and Deep TMS therapy. Services are provided both Online and Offline. Our services are designed to promote mental health and well-being.
• Positive Mind Care enables Users an appointment booking facility that allows Users to book an appointment through the Website.
• Positive Mind Care also provides many online/offline Health Services, enabling users to book these plans/packages online and make payments through the Website.

Payment and Refunds

Positive Mind Care accepts payment for services through a variety of methods, including online payment processing, direct billing to insurance providers, and other methods as determined by Positive Mind Care. Payment is due at the time services are rendered unless other arrangements have been made in advance. Positive Mind Care may suspend or terminate services if payment is not received.

• Payment Methods Positive Mind Care accepts payment through credit or debit card or UPI payments viathe online payment portal or in person at our office.
• Positive Mind Care accepts major credit cards such as Visa, Mastercard, American Express, and Discover.
• Refund Policy Positive Mind Care’s Refund Policy provides details on how refunds are processed. Refunds may vary depending on the type of service provided and the payment method used, as elaborated under.

1. Cancellation Policy: If an individual cancels their appointment less than 24 hours before their scheduled appointment, the full session fee will be charged. The session fee will also be charged if an individual fails to show up for their appointment without notifying PMC.
2. If cancellation is made more than 24 hours from the scheduled appointment time and the date and the patient has requested a refund, the request will be sent to the admin, who investigates the concerns and then orders the refund.The amount will be refunded within 15 working days from the cancellation request. However, 1.99% of the total fee will be deducted for gateway charges.
3. Refund Policy for Online Services: If an individual is unsatisfied with online services, they may request a refund within 14 days of the initial session. The request will be sent to the admin, who investigates the concerns and then orders the refund.The balance will be refunded within 15 working days of the cancellation request. However, 1.99% of the total fee will be deducted for gateway charges.
4. Refund Policy for In-Person Services: If an individual is unsatisfied with in-person services, they may request a refund within seven days of the initial session. The request will be sent to the admin, who investigates the concerns and then orders the refund.The balance will be refunded within 15 working days of the cancellation request. However, 1.99% of the total fee will be deducted for gateway charges.

We use a third party payment gateway for processing payments. The processing of payments will be subject to the terms, conditions, and privacy policies of the payment gateway in addition to these Terms. We don’t control and are not liable for the security or performance of the payment gateway. You agree to pay us, through the payment gateway, all charges at the rates then in effect for any purchase in accordance with the applicable payment terms.

Positive Mind Care (“PMC”) is committed to protecting the privacy of our clients. This Privacy Policy (“Policy”) explains how PMC collects, uses, and discloses personal information in the course of providing healthcare services.

PMC collects personal information in order to provide healthcare services. The information we collect may include:
